1. Agreement

These Terms of Use (“Terms”) govern your use of the Summit Coach iOS application and the website at summitcoach.app (together, the “Services”), provided by Sayegh (“we,” “us,” or “our”). By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. The Services

Summit Coach is a wellness coaching app that may provide fitness guidance, workout ideas, nutrition estimates, progress tracking, and conversational coaching features. Some features depend on Apple platforms and capabilities (including HealthKit and on-device Apple Foundation Models / Apple Intelligence) and may not be available on all devices or system versions.

3. Not medical advice

Important: The Services provide general wellness and fitness information only. They are not medical devices and do not provide medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare professional with any questions about a medical condition, exercise program, or diet. Never disregard professional medical advice because of something you read or receive in the App. If you think you may have a medical emergency, call emergency services immediately.

You are responsible for determining whether any exercise, nutrition target, or activity is appropriate for you. Stop activity and seek help if you feel pain, dizziness, or other concerning symptoms.

4. Eligibility

You must be able to enter a binding agreement under applicable law. The Services are not directed to children under 13 (or the minimum age required where you live). If you use the Services on behalf of someone else, you represent you have authority to accept these Terms for them.

5. License

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control, as permitted by the App Store terms. You may not copy, modify, distribute, reverse engineer, or create derivative works of the Services except as allowed by law.

6. Your responsibilities

  • Provide accurate information you choose to enter (goals, logs, etc.).
  • Use the Services only for lawful, personal wellness purposes.
  • Keep your device and Apple ID secure.
  • Do not misuse the Services (including attempting to disrupt, scrape at abusive scale, or bypass safety features).
  • Review and manage iOS permissions (Health, Camera, Photos, Notifications) according to your preferences.

7. AI-generated content

Coaching messages, workout plans, insights, and nutrition estimates may be generated or assisted by on-device AI models. Outputs can be incomplete, inaccurate, or unsuitable for your situation. Treat them as general guidance. Verify important decisions with qualified professionals. Meal photo estimates are approximate and intended to be reviewed and edited by you.

8. Health data and privacy

Your use of Health-related features is optional and controlled by iOS permissions. Our handling of information is described in the Privacy Policy, which is incorporated by reference.

9. App Store; Apple

If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and Sayegh, not Apple, and that Apple is not responsible for the App or its content. Apple has no obligation to furnish maintenance or support. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the App. Apple is a third-party beneficiary of these Terms solely as they relate to your license to the App, and may enforce them against you. You must comply with applicable third-party terms when using the App.

10. Intellectual property

The Services, including name, logo, design, and software, are owned by Sayegh or its licensors and are protected by law. Feedback you send us may be used to improve the Services without obligation to you.

11. Disclaimer of warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or that AI outputs will meet your expectations.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAYEGH AND ITS AFFILIATES, OFFICERS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

13. Indemnity

You agree to defend and hold harmless Sayegh from claims arising out of your misuse of the Services or violation of these Terms, to the extent permitted by law.

14. Changes and termination

We may update the Services and these Terms. Continued use after changes means you accept the updated Terms. We may suspend or stop providing the Services, and you may stop using them at any time by deleting the App.

15. Governing law

These Terms are governed by the laws of the United States, excluding conflict-of-law rules, unless mandatory consumer protections in your place of residence provide otherwise. Venue and jurisdiction will be determined in accordance with applicable law and your consumer rights.
